[공무] Interest for delayed and unpaid payments, 기성지연 이자 청구

발주처가 기성을 안 줘서 이자를 청구하는 프로젝트 경험해 본 사람도 얼마 없을 것 같다. 암튼 좋은 경험이다.

without prejudice to the provisions of contract should any payment due under contract by one party to the other party not be made on the due date thereof, the party required to make payment to the other shall, in addition to the amount otherwise due, pay interest on the outstanding amount at a rate two(2) percent per annum above LIBOR, calculated on a daily basis from the date payment was due until the date payment is actually made.

고민사항은 이자의 이자를 청구해야 하는 건지 그건 manager의 결정과 amicable relationship with Client 고려하여 결정해야 할 것이다.

LIBOR(London Interbank Offered Rate) Rate는 쉽게 말해 영국 런던에서 우량은행끼리 단기자금을 거래할 때 적용하는 금리로 일별, 주별, 월별, 연별 Libor rate가 다르기 때문에, 계약서에 어떻게 반영하는지 확인하고 없다면 내가 알아서 적용한 값을 발주처와 공유하면 된다.

우리는 two(2) percent per annum above LIBOR 라 명기되어 있다.

​

Final invoice 제출 후 30일 내 지급해야 하므로, 30일이 지난 다음부터 LIBOR+2% 가산하여 제출하면 된다. 이때 중요한 건 Gross에서 하냐, Net에서 하냐인데. Gross는 AP가 걸려 있기 때문에, Net에서 가산 들어가야 한다.
